Privacy Agreement

This is a special reminder to user, please read this Privacy Agreement carefully (hereinafter referred to as “Agreement”), ensure that you fully understand the terms of this Agreement. Please read carefully and choose to accept or not accept this Agreement. Your use and other actions will be deemed as acceptance of this Agreement, and agree to be bound by the terms of this Agreement. This Agreement stipulates the rights and obligations between BIONICFRONT INC. (hereinafter referred to as “BIONICFRONT”) and the user regarding the software service of XIBAOToy (hereinafter referred to as "Service"). "User" means an individual who uses the Service. This Agreement may be renewed at any time by XIBAOToy, once published, the App will notify you to check the latest terms of the Agreement, the updated terms of the Agreement shall replace the original terms of the Agreement. If the user does not accept the revised terms after the modification of the Agreement, please stop using the Service immediately. If the user continues to use the Service, it will be regarded as accepting the revised Agreement.

1.1 XIBAOToy value users' privacy. When you use our service, we may collect and use your related information. We expect to use this Agreement to explain to you how we collect, use, and store and share such information when you using our Service, as well as the means how we access, update, control and protect such information. This Agreement is closely related to the Service you use. We encourage you to read it carefully and make the appropriate choice according to the guidelines in this Agreement when necessary.  We will try to be as concise as possible in the relevant technical terms involved in this Agreement, and provide links for further explanation for your understanding.

1.2 By using or continuing to use our Service, you consent to us collecting, using, storing and sharing your information in accordance with this Agreement.

1.3 If you have any question about this Agreement, please contact us on our official website www.xibaotoy.com.

2.1 We may collect, store and use the following information about you when we provide the Service. If you do not provide the relevant information, you may not be able to become a user of us or enjoy certain services provided by us, or may not be able to achieve the desired effects of the relevant services.

3.1 Shared information that you provide to other parties through our Service and information stored when you use our Service.

4.1 Shared information about you provided by other parties when they use our service.

5.1 We may collect the following information when you use the Service.

5.1.1 Log information refers to the technical information that the system may automatically collect when you use our Services, including as below

5.1.1.1 Device or software information, such as the configuration information provided by your mobile device, web browser or other programs used to access our services, your IP information and the version and device identifier used by the terminal device (IDFA/IDFV).

5.1.1.2 Information searched for or browsed when using our Service, such as search terms you use, pages you visit, and other information, content details you browse or request to provide when using our Service.

5.1.1.3 Information about apps and other software you have used, as well as information about such mobile apps and software you have used.

5.1.2 Location information refers to the information about your location collected when you enable device location function and use location-based services provided by us, including as below

5.1.2.1 Your geographic location information collected through GPS or WiFi when you use our Service through terminal devices with locate function.

5.1.2.2 Real-time information provided by you or other users that contains your geographical location, such as information about your local area contained in the account information provided by you. Shared information uploaded by you or others that shows your current or previous geographic location, and geo-tagged information contained in photos shared by you or others;

5.1.2.3 You can stop the collection of your location information by turning off the locate function.

5.1.2.4 Bluetooth function.  Note: You need to turn on the location information to use Bluetooth function.

6.1.1 Data will not be shared with any third party other than a third party authentication system;

6.1.2 According to laws and regulations, if the government, Police and other competent authorities with valid certificates require us to provide user data, we will cooperate according to the circumstances.

6.2.1 We may use the information collected in the course of providing the services to you for the following purposes;

6.2.1.1 To provide services to you.

6.2.1.2 For authentication, customer service, security prevention, fraud monitoring, archiving and backup purposes when we provide services to ensure the security of the products and services we provide to you.

6.2.1.3 Provide your information to third party service providers in a manner permitted by law to help us design new services and improve our existing services.

6.2.1.4 Learn more about how you access and use our services,  to respond to your personalized needs, such as language Settings, location Settings, personalized help services and instructions, or otherwise respond to you and other users.

6.2.1.5 To provide you with the relevant commodity, service information.

6.2.1.5 To invite you to participate in a survey of our products and services.

6.2.2 To offer you a better experience. In accordance with the relevant laws and regulations, we may use the information collected by one service for our other services in a way of information collection or personalization. For example, information collected when you use one of our services may be used in another service to provide you with specific content or to show you information relevant to you that is not universally pushed. You may also authorize us to use the information provided and stored by the Service for our other services if we provide the option in the relevant service.

7.1 We will make every effort to take appropriate technical measures to ensure that you can access, update and correct your registration information or other personal information provided by you when using our Service. When you are accessing, updating, correcting or deleting the foregoing information, we may require you to verify your identity to protect the security of your account.

8.1 We and our affiliates will not share your personal Information with any third party without your consent, except in the following circumstances.

8.1.1 We may share your personal information with our affiliates, partners, and third party service suppliers, contractors, and agents (such as Communication Service provider and Map service provider, who may not in your scope of law), used for the following purposes.

8.1.1.1 To provide you with our services.

8.1.1.2 Achieve the purpose which 6.6 item says.

8.1.1.3 To fulfill our obligations and exercise our rights under this Agreement.

8.1.1.4 To understand, maintain and improve our services.

8.1.2 In order to enable you to use the following services and functions, third-party SDKS will be connected to our App

8.1.2.1 To Push or deliver notification messages.  The SDK needs to read your device information for Terminal Model adaptation.

8.1.2.2 If you use the function of sharing information with other apps, the SDK will collect information related to your device.

8.1.2.3 If you use the payment function and the third-party payment institutions cooperating with us provide services to you, the third-party payment SDK needs to collect information related to the device.

8.1.2.4 In order to analyze and count the user effect of our services, the SDK provided by GrowingIO and Umeng will collect the information related to your device, such as uploading "IMEI" to Beijing GrowingIO Technology Co., LTD.  

8.2 We will authorized partners access to information about application program interface (API) and software development kit (SDK) for rigorous safety testing, and agreed with authorized partners strict data protection measures, make it according to our purpose, service description, the privacy policy of this Agreement and any other relevant confidentiality and security measures to deal with personal information.

8.3 With the continuous improvement of our business, we and our affiliates may enter into mergers, acquisitions, asset transfers or some other similar transactions, and your personal information may be transferred as part of such transactions.  We will inform you before the transfer.

8.4 We or our affiliates may also retain, preserve or disclose your personal information for the following purposes.

8.4.1 Comply with applicable laws and regulations.

8.4.2 Comply with court orders or other legal procedures.

8.4.3 Comply with the requirements of the relevant government authorities.

8.4.4 To comply with applicable laws and regulations, to protect the public interest, or to protect the personal and property safety of us or our group companies, other users or employees.

9.1 We retain your personal information only for the period necessary for the purpose set forth herein and for the period required by laws and regulations.

9.2 We use a variety of security technologies and procedures to protect against loss, misuse, unauthorized access or disclosure of information.  For example, in some services, we will use encryption techniques (such as SSL) to protect the personal information you provide. However, please understand that due to technical limitations and various malicious means that may exist, in the Internet industry, even if we do our best to strengthen security measures, it is not always possible to ensure 100% security of information.  You need to understand that the systems and communication networks you use to access our services may have problems due to factors beyond our control.

10.1 Our services allow you to publicly share information about yourself not only with your own social network, but with all users who use the service. For example, information you upload or post on our services (Including the personal information you disclose, the list you create)；Your responses to information uploaded or posted by others, as well as location data and log information relating to such information. Other users of our services may also share information about you（Including location data and log information）.  Our social media services are designed to enable you to share information with users around the world, in real time and widely. As long as you do not delete shared information, it remains in the public domain.  Even if you delete shared Information, the information may be independently cached, copied or stored by other users or unaffiliated third parties not under our control, or held in the public domain by other users or such third parties.

10.2 Please carefully consider the content of information uploaded, published and communicated through our services.  In some cases, you may control the range of users who have access to your shared information through the privacy Settings of some of our services. To remove your information from our services, please operate according to the way which these special Terms provide.

10.3 Changing or withdrawing certain authorized business functions and services will require your information to complete, and each business function activation requires some basic personal information to complete. For the collection and use of additional personal information, you can set it in the application or contact the customer service of the platform to withdraw your authorization agreement. After you withdraw your consent or authorization, we cannot continue to provide you with the functions and services, and will no longer process your personal information. However, your decision to withdraw your consent or authorization will not affect our previous processing of personal information based on your authorization.

11.1 Some personal information may be considered as sensitive personal information due to its special characteristics, such as your race, religion, personal health and medical information, etc.  Sensitive personal information is protected more strictly than other personal information.

11.2 Please note that the content and information you provide, upload or post when using our services (such as photos related to your social activities) may disclose your sensitive personal information.  You need to carefully consider whether to disclose sensitive personal information when using our services.

11.3 You agree to treat your sensitive personal Information for the purposes and in the manner described in this Agreement.

12.1 We or our third party partners may collect and use your information through cookies and Webbeacon and store such information as log information.

12.2 We use our own technology for the purpose of providing you with a more personalized user experience and services and for the following purposes.

12.2.1 Remember your identity, to help us identify you as a registered user, or to store any information you provide us about your preferences and some others.

12.2.2 Analyze your use of our services to understand your preferences.

12.2.3 Advertising optimization. Based on your information, we recommend your in-app product and service information.

12.3 In addition to the above purposes, we may understand users' use habit of our services through data analysis and use it as the basis for us to recommend in-app (non-third-party advertising) products and services to you.

12.4 Our products and services may use the information collection technology of a third party data analysis service provider. These technologies may collect some personally information related to you to analyze how users use the services, to enable us to push information about in-app (non-third-party advertising) goods and services to you that you may be interested in, or to evaluate the effectiveness of advertising services. The collection and use of such information by third party technologies is not bound by this Agreement, but by the privacy policies of the relevant users, and we shall not be responsible for such third party technologies.

13.1 We may use your relevant information to provide you with information about in-app goods and services that are more relevant to you.

13.2 We may also use your information to send marketing messages to you through our services, email or other means ,in order to promote the following goods and services of us or third parties.

13.2.1 Our goods or services, Goods or services of affiliates and partners, including instant messaging services, online media service, interactive entertainment services, social network services, and payment services, Internet search services, location and map service, application software and services, data management software and services, online advertising services, finance, Internet and other social media, entertainment, e-commerce, information and communication software or services (collectively "web services").

13.2.2 In order to ensure user experience, we will not push any product or service information irrelevant to the APP to you for the time being.

13.3 If you do not want us to use your personal Information for such advertising purposes, you may request us to stop using your personal information for such purposes through the relevant tips provided by us in advertising or the guidelines provided by us in specific services.

14.1 Information push

14.1.1 When you use our services, we may use your information to send short messages or push notifications to your devices.  If you do not want to receive these messages, you can choose to unsubscribe on your device according to our relevant prompts.

14.2 Service related announcements

14.2.1 We may make announcements related to the services to you as necessary. (When a service is suspended for system maintenance)You may not be able to cancel these announcements that are service-related and not promotional in nature.

14.3 Applicable outside the agreement

14.3.1 Our services may include or link to social media or other services (including websites) provided by third parties.

14.3.1.1 You use the "Share" button to share certain content to our services, or you use a third-party connection service to log in to our services.  These features may collect information about you (including your log information).

14.3.1.2 We provide you with links through advertising or other means of our services that enable you to access third party services or websites, the third party social media or other services may be operated by relevant third parties or by us. Your use of third party's social media services or other services is subject to the terms of service and privacy policy of such third party, which you need to read carefully. This Agreement only applies to the information collected by us and does not apply to the services provided by any third party or the rules governing the use of information by any third party. We are not responsible for any third party's use of the information provided by you.

15.1 Minors under the age of 18 are prohibited from using our services.

16.1 This Agreement applies to all of our services except for certain specific services. These specific services will be subject to specific privacy policies. Specific privacy policies for specific services will be more specific about how we use your information in those services. The privacy Policy for this particular Service forms part of this Agreement. In case of any inconsistency between the privacy policy of the relevant particular service and this Agreement, the privacy policy of the particular service shall apply.

16.2 Please note that this Agreement does not apply to the following situation.

16.2.1 Information collected by third party services accessed through our services (including any third party websites)

16.2.2 Information collected by other companies or organizations that perform data analysis services in our services.

17.1 We may amend the terms of this Agreement in due course, and if your rights under this Agreement are reduced as a result of the amendment, we will notify you by homepage notice or email or other means before the amendment becomes effective. In such cases, by continuing to use our services, you agree to be bound by the revised Agreement.
